Terms and Conditions
General terms and conditions of sale of Project Camper GmbH for online sales on www.project-camper.fr. This English version is provided for information purposes only. The contract is concluded in French and only the French version of these terms and conditions (Conditions générales de vente) is legally binding.

Article 1: Scope and definitions
(1) These general terms and conditions of sale (hereinafter "Terms and Conditions") apply to all orders placed by a consumer in our online shop https://www.project-camper.fr in the version valid at the time of the order.
(2) "Consumer" within the meaning of these Terms and Conditions is any natural person acting for purposes which are outside their trade, business, craft, profession or agricultural activity.

Article 3: Order and conclusion of the contract
(1) The presentation of products in our online shop does not constitute a binding offer on our part, but merely a non-binding invitation to place an order. Many products are made to measure for your vehicle according to the details you provide when ordering.
(2) The order proceeds in the following steps:
1) selection of the desired products and, where applicable, options (vehicle model, windows, colours, etc.);
2) entry of billing and delivery details, choice of delivery and payment method;
3) review of the order summary, with the possibility of correcting input errors before submitting the order, and acceptance of these Terms and Conditions;
4) submission of the order by clicking the order button, which clearly indicates that the order involves an obligation to pay.
(3) By submitting the order, the consumer makes a binding offer to conclude a purchase contract. We acknowledge receipt of the order by an automatic email ("acknowledgement of receipt of your order"), which does not constitute acceptance of the order. After reviewing the order, we accept it by sending you the payment link by email ("order acceptance"); the contract is concluded when you receive this email. If we cannot accept the order, for example because the vehicle details are incomplete or contradictory, we will inform you by email; you will then not be asked to pay.
(4) We provide you with confirmation of the contract on a durable medium: the acknowledgement of receipt of your order and the payment confirmation email set out the essential characteristics of the products ordered and the total price and contain the full text of these Terms and Conditions, the information on the right of withdrawal and the model withdrawal form, in the legally binding French version and in English. We recommend that you keep these emails.
(5) These Terms and Conditions can be viewed at any time at https://www.project-camper.fr/en/agb and can be saved or printed. For orders of EUR 120 or more (including VAT), we keep a record of the contract for ten years from delivery and guarantee you access to it at any time on request to contact@project-camper.fr (Articles L213-1 and D213-1 et seq. of the French Consumer Code).
Article 4: Prices
(1) Prices are stated in euros including VAT and all other price components. For delivery to France (including Monaco), they include French VAT at the applicable rate (currently 20%). For delivery to another EU Member State, the VAT of the destination country applies; for delivery outside the European Union, prices are charged without VAT and any import duties and taxes are payable by the recipient. The final total price is displayed before the order is submitted.
(2) Shipping costs are not included in the product prices. They are stated on the page Shipping and Payment and displayed before the order is submitted.
Article 5: Payment
(1) Payment is processed by our payment service provider Mollie B.V. (Amsterdam, Netherlands). When ordering, you state your preferred payment method. After accepting the order, we send you a secure payment link by email; on the payment page you can pay with the stated method or with another of the payment methods offered (in particular credit/debit card, PayPal or bank transfer).
(2) The price is due upon conclusion of the contract, i.e. when you receive the email containing the payment link. Production and shipping start after receipt of payment.
Article 6: Delivery
(1) Delivery is made to the delivery address provided by the consumer, within the delivery countries offered during checkout. We deliver to mainland France (including Corsica) and Monaco. We do not deliver to the French overseas territories (Guadeloupe, Martinique, French Guiana, Réunion, Mayotte, Saint Pierre and Miquelon, Saint Barthélemy, Saint Martin, Wallis and Futuna, French Polynesia, New Caledonia, French Southern and Antarctic Lands). The delivery countries and shipping costs are listed on the page Shipping and Payment. You can also choose to collect your order from our premises in Hamburg (address in Article 2) during the opening hours shown when ordering.
(2) The delivery time is stated on the product page and in the order confirmation. It starts upon receipt of payment. Made-to-measure products require a production time which is included in the stated delivery time. If no delivery time is stated, we deliver no later than thirty days after conclusion of the contract (Article L216-1 of the French Consumer Code).
(3) If the delivery date or time is not met, the consumer may terminate the contract by registered letter with acknowledgement of receipt or in writing on another durable medium if, after having requested us in the same way to deliver within a reasonable additional period, we have not delivered within that period. The consumer may terminate the contract immediately if we refuse to deliver or it is clear that we will not deliver, or if the delivery date or time was an essential condition of the contract for the consumer. Any sums paid will be refunded no later than fourteen days after the date on which the contract was terminated (Articles L216-6 and L216-7 of the French Consumer Code).
(4) The risk of loss of or damage to the products passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier proposed by us, takes physical possession of the products (Article L216-4 of the French Consumer Code).
Article 7: Retention of title
The products remain our property until the purchase price has been paid in full.
Article 8: Right of withdrawal
(1) The consumer has a fourteen-day right of withdrawal under the conditions described on the page Right of withdrawal, which also contains the model withdrawal form.
(2) In accordance with Article L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods made to the consumer's specifications or clearly personalised. This concerns the products that we manufacture after the order specifically for the vehicle and according to the consumer's details (vehicle model, version and year, windows, dimensions, colours, options), in particular magnet thermal mats, magnetic mosquito nets, exterior insulation, bag systems and bags made to order. The product page and the order summary show the options you choose for your vehicle.
(3) The fourteen-day right of withdrawal applies without restriction to items available from stock (categories "Stock Items" and "B-stock" (second choice)), to accessories that are not made to measure (category "Accessories") and to gift cards.
(4) The consumer may also withdraw online using the “Withdraw from contract here” function, available at the bottom of every page throughout the withdrawal period. We will acknowledge receipt of the withdrawal by email without undue delay, stating its content and the date and time of its receipt.
Article 9: Legal guarantees
All our products are covered by the legal guarantee of conformity (Articles L217-1 to L217-32 of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code). For any claim under these guarantees, please contact us at retour@project-camper.fr or by post at the address given in Article 2.
Legal guarantees: mandatory information
The consumer has two years from delivery of the goods to claim under the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to prove the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to this digital content or digital service throughout the intended period of supply. During this period, the consumer only has to prove the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity obliges the trader, where applicable, to supply all updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience to the consumer.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction of the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:
1° the trader refuses to repair or replace the goods;
2° the repair or replacement takes place after a period of thirty days;
3° the repair or replacement causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° the lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In this case, the consumer is not required to request repair or replacement first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The above rights result from Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the implementation of the legal guarantee of conformity in bad faith is liable to a civil fine of up to EUR 300,000, which may be increased to up to 10% of the average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund against return of the goods.

Article 11: Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer dispute resolution body.

Article 12: Personal data and telephone marketing
(1) The consumer's personal data is processed in accordance with our privacy policy.
(2) Consumers who do not wish to receive telephone marketing calls can register free of charge on the French telephone marketing opt-out list Bloctel (www.bloctel.gouv.fr) (Article L223-2 of the French Consumer Code). We use the telephone number provided with the order only for processing the order and delivery.
Article 13: Applicable law and jurisdiction
(1) The contract is governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). However, this choice of law may not deprive a consumer habitually resident in France of the protection afforded by the mandatory provisions of French law, in particular the French Consumer Code (Article 6(2) of Regulation (EC) No 593/2008 "Rome I").
(2) The consumer may bring proceedings before the courts of the EU Member State in which they are domiciled or before the German courts (Article 18 of Regulation (EU) No 1215/2012).

The contract is concluded in French. Translations of these Terms and Conditions into other languages are provided for information purposes only; only the French version is legally binding.
